The Government to plans to give civil servants the power to confiscate the driving licence or passport of fathers who they think are behind with their CSA payments without the need to obtain a Court Order. This was actually rejected last year as part of the child support review, but it looks like it&#8217;s getting snook in the back door.</p>

			<content:encoded><![CDATA[<p>I blogged about this a few weeks ago. <a href="http://www.duped-dads.com/2009/01/22/paternity-fraud-victim-attempt-to-claim-damages/">Mark Webb who was trying to claim damages</a> from his ex and her lover and lost has lost to right to retry the claim at the court of appeal. Lawyer Paul Dumbleton, from his ex&#8217;s firm, said: “Frankly, the case should never have been brought&#8221;.</p>
<p>This must be absolutely devastating for Mark, as well as the children concerned in this case. I think that it is more about getting some sort of justice and revenge against the ex-wife rather than financial gain. His wife and her lover knowingly deceived Mark for 17 years.</p>
<p>Mark now plans to take this case to Europe. We wish him luck.</p>]]></content:encoded>

<blockquote><p>A panel of Nevada senators grappled Friday with two bills to change family law in Nevada &#8211; one to ensure family members of a divorcing couple can attend divorce hearings, and another to fight <a title="paternity fraud" href="http://www.duped-dads.com/paternity-fraud/">paternity fraud</a>.</p>

<p>The committee also heard testimony on AB117, which would create the misdemeanor crime of &#8220;paternity fraud,&#8221; typically where a man sends a friend or other impostor to take a required <a title="DNA test" href="http://www.duped-dads.com/paternity-test/">DNA test</a> to determine who the father of a child is. Test-evading fathers and their impostor assistants can&#8217;t be charged under current law, although they can be held in contempt of court.</p>
<p>&#8220;We look forward to the day when we can post very visible signs that warn would-be impostors and those who would recruit them that the fraud they intend to commit is not only morally reprehensible but can land them in jail,&#8221; said Ed Ewert, a Clark County deputy district attorney who works in family law.</p>
<p>Ewert estimated the impostor cases make up only 1 to 2 percent of <a title="DNA testing" href="http://www.duped-dads.com/paternity-test/">DNA testing</a> cases. But a man who gets away with it can escape paying tens of thousands of dollars over a child&#8217;s lifetime, he said.</p>
<p>The crime would carry a penalty of up to six months in jail and a $1,000 fine. Ewert suggested lawmakers amend the bill to make the crime a gross misdemeanor, which would double the allowable fines and jail terms.</p>
<p>Judiciary Chairman Mark Amodei, R-Carson City, said the committee might consider even stiffer penalties.</p>
<p>&#8220;If you&#8217;re trying to defraud someone out of $6,000 a year for about 20 years, that would be felony range if I stole it,&#8221; said Amodei.</p>
<p>No one spoke in opposition to either bill on Friday. The Assembly voted unanimously in favor of both bills last week.

<p>Although this is a step in the right direction, the judge still dismissed his claims of £37,000 that he had paid out for nursery fees.</p>
<p>The mother still claims that she had no reason to believe the child was not is, and had not deliberately duped the dad. The judge concluded that it would be impossible to accept this woman as a witness of truth.</p>
<p>Well ain&#8217;t that the truth.</p>
<p>While this is definitely progress, being the 1st case of its kind. It still does not fully compensate the duped dad enough since he was deemed to have got &#8216;great enjoyment&#8217; from his relationship with the child.</p>

<p>Paul Simpson had reason to suspect that he wasn&#8217;t going to like the results even before he took a <a title="paternity test" href="http://www.duped-dads.com/paternity-test/">paternity test</a>. Another man, whom Simpson had become friendly with, had confessed to him that he, not Simpson, was the father of the two children born during Simpson&#8217;s marriage.</p>
<p>Still, Simpson said he hoped that at least one of the children, who were both under the age of 2, would turn out to be his biological child. The professionally administered <a title="DNA test" href="http://www.duped-dads.com/paternity-test/">DNA test</a> showed neither was.<br />&#8220;It&#8217;s hard to describe how bad I felt,&#8221; said Simpson, 25, who is now divorced from the children&#8217;s mother. He was angry, then severely depressed. But he did not regret taking the test. &#8220;I had to know if they were mine&#8211;I had to.&#8221;</p>
<p>DNA tests to prove parentage are becoming more common and easily accessible. You can order a do-it-yourself kit online for about $200, though those tests aren&#8217;t admissible in court, or pay $500 for one involving professional sample collections.</p>

<p>Resolution, which represents about 5,000 family lawyers, says the present system creates a &#8220;blame culture&#8221;.</p>
<p>Group chairman Jane McCulloch said it was wrong that &#8220;unreasonable behaviour&#8221; or adultery had to be proved to obtain an immediate divorce.</p>
<p>There were 141,750 divorces in England and Wales in 2005, 10,940 in Scotland and 2,362 in Northern Ireland.</p>
<p>Ms McCulloch was speaking at the national conference of Resolution, formerly known as the Solicitors Family Law Association, in Manchester.</p>

<p>She said: &#8220;Under current law, anyone wanting an immediate divorce has to prove &#8216;unreasonable behaviour&#8217; or adultery on the part of their husband or wife.</p>
<p>&#8220;This &#8216;blame culture&#8217; of unreasonable behaviour introduces a degree of discord and unpleasantness into divorce proceedings from their very inception.&#8221;</p>
<p>She said Resolution supported provisions in the 1996 Family Law Act for &#8220;no-fault&#8221; divorces, which were later shelved.</p>
<p>Pre-nuptial agreements</p>
<p>&#8220;If the government is serious about promoting amicable settlements through mediation and streamlined courts, it should commit to undertaking a thorough review of family law to deal with these issues,&#8221; she said.</p>
<p>Such a review could bring family law up to date by addressing issues such as the rights of couples who live together and the position of pre-nuptial agreements, she added.</p>
<p>Last year Court of Appeal judge Lord Justice Wall called for an end to fault-based divorces to help prevent acrimonious break-ups.</p>
<p>He said he wanted a new system which put the needs of children and financial provision at the heart of the divorce process.</p>
